Abstract
There is a need to legislate and improve the legal standards on the protection and defense of the consumer and/or user while promoting a culture of peace and consumption with the particularity of protecting them, especially when their legitimate interests may be affected, in through information asymmetry or imbalance, compared to the advantageous situation of the provider, which is called upon to avoid infringing behavior, so special attention must be paid to the relationship and situation presented around consumption. It is justifiable to stop the growing violence and of course come to the aid of the weakest, as in any order of things, and from a legal perspective, violence or the abusive exercise by action or omission of law cannot be allowed, for any person and in this case, neither allow such action by the supplier in the market. Then, it assumes of vulnerability of the consumer and protect the sovereignty of the latter, bearing in mind that in the social market economy, constitutionally recognized in Peru and in accordance with the Consumer Protection and Defense Code, protection must be interpreted in the most favorable sense to the consumer. In turn, it is up to the State to fulfill the protective role in favor of consumers; In other words, it is not a question of ensuring only economic growth, but of paving the way for social justice in these aspects as well; Hence the need to have legislative adjustments and instruments, such as the complaints book, that make it easier to resolve disputes directly and rapid
